By accessing or using the SnapToSell website located at snaptosell.com (the "Site"), any associated mobile application, the SnapToSell Assistant browser extension, or any related service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Snap To Sell, LLC, a North Carolina limited liability company ("Company," "we," "us," or "our").
SnapToSell is an AI-powered platform designed to assist users in identifying, pricing, and listing items for sale on peer-to-peer marketplaces, while providing fraud detection and trust verification features.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.
The Service is not directed to children under the age of 18. We do not knowingly collect personal information from anyone under 18. If we become aware that a person under 18 has created an account or provided personal information, we will take steps to delete such information and terminate the account promptly. If you believe a person under 18 has provided us with personal information, please contact us immediately at support@snaptosell.com.
You may be required to create an account to access certain features. You agree to provide accurate, complete, and current information and to maintain and promptly update your account information.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@snaptosell.com of any unauthorized use of your account.
You may not create multiple accounts to circumvent any limitations or abuse the Service.
SnapToSell uses artificial intelligence and machine learning to provide product identification, pricing estimates, and fraud risk assessments. You acknowledge and agree that:

We reserve the right to remove any listing and suspend or terminate accounts that violate these restrictions.
The Service may include free and paid features. Current pricing, subscription plans, and billing details will be published at snaptosell.com/pricing and are incorporated into these Terms by reference. We reserve the right to modify pricing at any time with 30 days' prior notice to existing subscribers.
Payments are processed through third-party payment processors. By using the Service, you agree to the payment processor's terms of service.
Subscription fees are generally non-refundable except as required by applicable law. If we terminate your account without cause, you will receive a pro-rated refund of any prepaid subscription fees for the unused portion of your billing cycle.
You are responsible for determining and paying any taxes applicable to your transactions. SnapToSell may be required to collect and remit sales tax in certain jurisdictions.
Transactions conducted through the Service may involve in-person meetings between buyers and sellers for item exchange. SnapToSell does not arrange, facilitate, or supervise in-person meetings and is not responsible for the conduct of any user during such meetings.
User Responsibility: You acknowledge and agree that you are solely responsible for your personal safety during any in-person transaction. SnapToSell strongly recommends meeting in well-lit, public places during daylight hours, bringing a friend or family member, informing others of your meeting plans, trusting your instincts, and never inviting strangers to your home.
No Liability: By using the Service, you acknowledge that SnapToSell is not a party to transactions between users and bears no responsibility for the actions, conduct, or safety of any user during in-person meetings. You agree to release and hold harmless SnapToSell from any claims arising from in-person transactions.
The Service uses artificial intelligence to identify items, suggest prices, and generate descriptions. While we strive for accuracy, AI-generated content is provided for convenience and may contain errors. You are responsible for reviewing and editing all AI-generated content before publishing listings. SnapToSell is not liable for any inaccuracies in AI-generated content.
The SnapToSell Assistant browser extension is part of the Service. It helps you pre-fill marketplace create-listing forms using items from your own SnapToSell inventory. You always review the filled-in form and click the marketplace's own Publish / Post button yourself. The extension never publishes or submits a listing on your behalf.
You retain ownership of content you submit to the Service. By submitting content, you grant SnapToSell a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your content in connection with operating the Service. This license does not grant SnapToSell the right to use your content in paid advertising or promotional materials without your separate, express consent.
You represent and warrant that you have all necessary rights to the content you submit and that your content does not violate any third-party rights or applicable laws.
The Service, including its design, features, functionality, and content (excluding user content), is owned by SnapToSell and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
SnapToSell respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Service if such claims are reported to our designated Copyright Agent.
If you believe content infringes your copyright, email support@snaptosell.com with the information required by 17 U.S.C. § 512(c). If you believe your content was removed by mistake, you may submit a counter-notification under 17 U.S.C. § 512(g). We may terminate repeat infringers and may remove content for policy or legal reasons.
The Service may integrate with third-party platforms (e.g., eBay, Facebook Marketplace, Craigslist). These integrations are subject to the terms and privacy policies of those platforms. We are not responsible for the actions, content, or practices of any third-party services.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, SnapToSell disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate. We do not guarantee the identity, authenticity, or reliability of any user or the quality of items listed on the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, SNAPTOSELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to SnapToSell in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
You agree to indemnify, defend, and hold harmless SnapToSell and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Before initiating formal proceedings, you agree to contact support@snaptosell.com for at least thirty (30) days of informal resolution. If unresolved, disputes are subject to binding arbitration in North Carolina under AAA rules, except eligible small claims matters. You waive jury trial and class/representative actions. You may opt out of arbitration within thirty (30) days of first accepting these Terms by emailing support@snaptosell.com.
We may suspend or terminate accounts for violations, fraud, abuse, safety risks, or legal requirements. You may close your account at any time. Sections that by nature should survive termination will survive.
You may request export of your listing, transaction, and account data by emailing support@snaptosell.com. Following termination, we retain data as described in the Privacy Policy, including legal/compliance retention and fraud/safety retention. See also our account deletion page.
SnapToSell is not liable for delays or failures caused by events beyond reasonable control, including infrastructure outages, third-party failures, natural disasters, cyberattacks, or government actions.
These Terms are governed by North Carolina law. Subject to arbitration in Section 19, exclusive jurisdiction is in the state or federal courts located in Chatham County, North Carolina.
By using the Service, you acknowledge that data may be processed in the United States and other countries where our providers operate, in compliance with applicable law.
We may update these Terms at any time. Material changes will be posted on the Site with an updated date and advance notice where required. Continued use after the effective date means acceptance.
SnapToSell is not a consumer reporting agency as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) ("FCRA"). Fraud risk scores, trust indicators, and related outputs provided by the Service are not consumer reports and may not be used to determine eligibility for credit, employment, housing, insurance, or any other purpose governed by the FCRA or similar laws.
These Terms, the Privacy Policy, and any Regional Supplements are the entire agreement. If any provision is unenforceable, remaining provisions remain in effect. Failure to enforce is not a waiver. You may not assign without consent; we may assign without restriction.
